That's called 'piracy'. If you play any late version of Shiny Gold, the hack, you'll notice the words 'Say no to Piracy' are used quite often. This is because Zel, the hacker who created Shiny Gold, was aware that people were selling his hack. It is illegal, yes, because the pirates are taking credit for work they do not actually do. Hacks are intended to be free, and these pirates put hacks (that are often incomplete- explaining why you couldn't get to Cherrygrove) onto cartridges in order to make a quick buck. I know for a fact that there are markets in Turkey that sell hacks illegally on cartridges, and I've no doubt that this occurs elsewhere in the world.
To sum up: it's illegal to sell hacks on game packs/cartridges. If you try to sell someone a hack on a cartridge, you are ripping them off. If you buy a hack on a cartridge, you are being ripped off, because they are made to be distributed freely.
