Because Nintendo, knowing their track record, is definitely not going to have a problem with unauthorized fangames being made on their hardware. On top of that, you're getting money fore it via IndieGogo.
I hate to say it, but I'm 100% positive you're going to get a cease and desist for this once it gains any notoriety.

Well it seems ok, the idea of having a PC editor and it compiling/running on 3DS seems nice.
But the engine itself needs a lot of work. And I kind of agree with IceGod64, you're risking yourself of getting a C&D. Mostly because of the unauthorized use of the IP (Pokémon), and hardware. Normally people do homebrew, sure, but it's different.

I would had suggested you to get to a much more developed point before launching a campaign. What you have sure has its accomplishments but you need something flashy, not just a basic map editor prototype which doesn't even seem to support transparency. Again, I can say it's nice but that's just because I've done things too. People don't care about personal milestones.

But yeah, don't mind me, just keep up the good work, keep on it, even if the campaign fails.

thanks z_orochi we are working more on the pokemon engine itself. We will post alot of stuff like battling and other pokemon gameplay running on the 3DS soon!
