Nothing wrong with it and I've done it in the past 5 years. The only bother me since I made my own site is redistribution of other people's IPS (Other type) Patches.

Sometimes, I love to make movies based on ROM Screenshots from original games and never edit.

hacking isnt wrong we are actually doing good for nintendo, one of us from PC may get a job in nintendo where you help make a pokemon game :P

I think hacking is just fine I think it is a good thing to hack because if the producer of the game/games quit developing the games then we keep them going because we are hacking and or makeing our own version of the game so there for it still lives on!! so I think it is a good thing for hacking!!!!

sorry to tell you copyright law, states 70 years after author's death, 100 years for company (may vary slightly where you live and depends on reasonableness but nevertheless around that)

I reckons a lot of ppl think IPS distribution is okay. I can't argue with this at all, it is literally a gray area. Because you aren't distributing the ROM, but ROM modification data, and it is in the player's will to modify the ROM (though this satisfies my definition of distribution, I don't think it's a general definition).
The thing is the license says you can't modify your ROM (yep, says it). However, this term is unjust, think about it. If I bought a monitor with a license, "cannot modify the monitor", I doubt they can sue if I made it into a TV. Why? Does not help the interest of the Copyright Act. If you sold or distributed (gave it away), it would be a problem. However, if you made a video how to change a monitor to a TV, doubt they can do anything about it.

On the other hand, if the ROM hack disturbs the sales of current ROM (Diamond/sapphire/Platnium), that also may be a problem (this isn't really copyright law from here, pure economic loss).

It's in a gray area. If ROM makers had a way to stop ROM hackers, they would have done it already (ROM dumping for that matter).

The only way that I see anything bad coming out of Hacking, is if you try and make a profit off of it, for that is illegal. Other than that, it's a way to write a story, but have others play out the story, instead of reading it.

Downloading the official version of a game in the form of a rom is legal only if you own a genuine hardcopy of the game.
HACKING the MATERIAL from a copyrighted game is in no way, shape, or form legal in any standard.
Hacking is altering.
Altering is illegal.
Do the math.

I don't think hacking roms is right, persay, but I must agree that trying out different remakes and versions of the same game is a lot of fun.

I agree, If ROM makers don't agree then hacking would be illegal and hackers would be caught and brought to jail.

I may be going a bit off topic here, but I just wanted to make it clear that this isn't completely true. Private ownership of a ROM for a commercial game is only legal in some countries (this does not include the US), even if you do own the original cartridge. Even in the case it is legal in your country, yes, it is only for backup purposes, not modification as you mentioned in your post.

Nintendo doesn't really care whether you plan to modify and sell one of their games, it's still something that one could easily be fined for. To those who say that companies are not taking action regarding this, just try to find a rom of, for example, Super Mario World. For me, doing so yields many, many results, but on closer inspection, almost none are available for download to to ESA protection. So yes, in some cases it is very illegal to create a rom hack.

Well, ROM hacking is basicly making a derivative work without the copyright holder's consent. You could possibly be sued for it. I have seen a few times where Square Enix has threatened to take legal action against rom hackers and, in one case, a group who was gonna remake one of their games.

Wow I did not know that I always heard if you have a hard copy laying around the house they cant do nothing I guess I was wrong But I don't Think I Am I think you can have the rom's if it is a hark copy Guess I will have to Look into that even harder...lol. ^.^

I believe that is it okay to hack ROMs, so long as they are not pirated/sold of monetary gain.
THAT is where the line is, and crossing it wouldn't be tolerated.

actually even if you own a hard copy of the game it is still illegal to hack because that would be modifying the game which is against the law to do without the permission of the company who owns rights to whatever game ur changing, although i do think that law shouldnt apply if the person hacking is not using it to make money, but sadly its still against the law, the only thing is that some companies such as nintendo tend to overlook it because we arent selling the games...other companies like igg and moliyo enforce that law...i used to run a private server for Tales of pirates, and someone else who was running a server got sued by moliyo because they didnt have rights so i shut mine down, not to mention now on the tales of pirates site they constantly put a reminder saying that no1 but igg, moliyo, and some asian company have rights to run the game, and if someone is found to be running it then they will be sued to the full extent that the law allows.
