At the last minute before Judge Walker's temporary stay was about to expire, allowing same-sex marriages to resume in California, the 9th Circuit Court of Appeals issued an extension of that stay pending it's hearing on the Proposition 8 issue. This means that same-sex couples wishing to marry in California will have to wait until at least early December, if they will be able at all that is.
The 9th Circuit is awaiting briefs from Proposition 8 supporters, who lost at the District Court level, and its opponents on whether or not the plantiffs (now the appelants) have the legal standing to make an appeal. The plantiffs named in the federal case being appealed were California Governor Arnold Schwarzenegger and Attorney General Jerry Brown; both of whom support the overturning of Proposition 8 and said that they would not appeal Judge Walker's decision. A conservative group called ProtectMarriage.com represented the pro-Prop 8 side during the District Court trial and plan on doing the same at the 9th Circuit trial, if there will be a trial.
