    Hey guys!
    im new here and i have a question that might be simple for you guys but tough for me...
    anyways im a programmer and i have a vision of re-creating the old gameboy style games of pokemon into a new one using a small engine i made with c# and xna...
    now the problematic part is that im not sure that it is legal to make a fangame of pokemon ( although im gonna release it totally free and open source ).. so i wanted to know what i mustnt do in my game so i will not get sued by nintendo or any other company that could sue me on that matter....

    If you don't claim the copyrighted and trademarked information (e.g. Pokémon names) as your own by making money off of it or being an exact copy of a licensed Pokémon game, you are in no right to be sued.

    The only way to be in trouble with them is if you create a series of games based on their trademarks and they don't like it. That can be solved very easily by just removing all traces of data of that game off the Internet.

    But to be realistic, you aren't gonna get in any trouble, mainly because they have better things to do than crack down on ROM hackers and fan game developers, as you can see by our RH and GD forums.

      Well I believe you got your answer there. You may also google Nintendo's legal claims and so on for more information. I'll go ahead and lock this since it doesn't really pose as a discussion too much.
