i know im not part of the staff, but i do know legal things. sooner or later the pokemon people will find out, and that would be bad. i say that you attempt to make a license agreement. besides, if you have tons of people wanting to play this, the pokemon people will definatley not want to lose players due to a lawsuit. with my view, i just say push and push for a liscense agreement.

Eh, even with this game being out, people will still want to purchase the hand held games.
I don't think much will change when this is released.

This game isn't going to do anything to product sales.

First forget about pokemon for just a second, then think about the long run. Which would you rather prefer

A.) a free game that has all the locations and is more realistic
B.) a usually overpriced game that is very limited and leaves out a bunch of stuff

Which would you choose?

but there is always a crowd of lifeless geeks who never leave their house. and if you want to play something not on the cmputer, why are you even in this section? this section is sorta dedicated to internet games you play at home....but, the handhelds get bored real quick, and barely have any large reigons

so i say, Stay at Home! (results may vary)

I would like to recall a major Pokmon scandle that happened about 7 years ago.

About 7 years ago or so, a group of Japanese kids, decided to make a game, two games actually. One called Pokmon Jade, the other caleld Pokmon Diamond. After they created it, they shared it amongst themselves, and among their other online friends. The game was made purely out of passion for Pokmon.

But, after they released both games, a group of Chinese people, took the game, and then started creating actual gameboy games out of them, and then proceded to sell them. They were distributed every, under the impression of real Pokmon games, and I even bought them thinking they were real Pokmon games. But clearly, when I started the game, I could tell it wasn't.

But, Nintendo later got word of two fake Pokmon games being sold everywhere, and proceded to take action. Which they did, they found the group of kids who created the game. But the group of kids did not sell the game, the group of Chinese people did.

So, Nintendo investigated, and found the group of people who sold, and distributed the game. And they sued them for copyright infringement. And everything was settled. But the part that everyone forgets is that the people who created the game, did not face any law, or copyright problems. At ALL.

Now, heres is my game, Pokmon the Lost World. But it's much different though, why? Because its made with sphere. It's coded with javascript. Meaning that it can't be played on any known handheld system ever created. Only on computers. Javascript is a language used mostly for writing websites.

So please, stop worrying, it is fine. I'm not saying that Nintendo couldn't sue me on a whim, but what I'm saying is that the odds, and chances are extremely low. Have any of you heard of Pokmon Shiny Gold? I don't see Nintendo giving the CD to any other big games around here.


I myself will be looking into copyright information. But for now, do not worry about it,

Not playing them. There are a few betas out that i choose not to download cause i odnt like playing games on the computer.
Not all the games are internet games either.

If you'd like to know my opinion, I'd have to say B. I am a supporter (and much more then you may think :P) of this project, but I must say, as a fan, no game would ever be the same as a real Pokemon Game, nor could it ever replace them.

Umm, I'm pretty sure that CA isn't selling on the computer or not, so it really doesn't matter. Plenty of fan games have been "Published", and there have been no infringements or copyright law problems with Pokemon games on the computer.

Several years ago, the people running this section sent an e-mail to Nintendo and asked how they felt about fan games, and they said that they didn't mind them, unless they took the actual graphics from the games, which I don't think CA is doing, so I think we're in the clear.

I think nintendo can always sue someone who's making a pokemon game...
Hack or game, it stays copyright, if you change the name and make in in sphere or any other game maker there won't be a problem.
But the chances are like really low to get sued, I dont think anyone is sued on this forum, so it ain't gonna happen.
Just dont sell the games, cause they can sue you even more for that and probally they will if they find out.
Nintendo could learn of our ideas though -,-

I don't see why everyone is still fighting about this copyright infringement. Captain seems to know what hes doing, in terms of what he can do and what he can't. I'm just mainly focused on new updates, which should be awesome.

Diamond and Jade are actually just poorly translated versions of a real game, Telefang. The 'creators' just changed the title screen.

I think Crosell has it right. Anything you do with Pokémon is still breaching Nintendo's copyright, but Nintendo wouldn't want to waste their money suing some guy who's not even getting anything out of it.

As far as I know, CA is still using tiles and sprites from the official games.
Captain Arcane makes his own sprites and tiles,
look on the maps he made, do you see any tile that is completely the same as on any official pokemon game ?
They may look the same, but that's to create the effect of a real game.
If all of his stuff is custom, then there is not a single problem.
