VPN illegal?

It violates the Netflix terms of service to use one to watch their content, but otherwise there's nothing illegal about using a VPN. If VPNs weren't legal, telecommuting wouldn't be a thing, since that's what businesses use to connect work-from-home employees into their company networks as well as what multi-site businesses use to link together their multiple sites.

It's not like that's something they can enforce though. It's probably because they want to region lock their services. But VPN itself is pretty much legal, seeing how Tor itself is developed by the US government and it's practically an Ultra VPN.

It's actually not terribly difficult to enforce. At its most rudimentary, it's just denying traffic from specific address ranges.

Netflix doesn't want region lock their services but MPAA forces them to do it, the problem is that copyright system is outdated. Netflix actually didn't cared about people who bypassed the region lock until MPAA threated them with lawsuit.

Netflix's CEO has even stated that they want to end the region locking: https://www.buzzfeed.com/alexlee/netflix-giving-vpns-the-flix?utm_term=.bglpNXvX1#.dnDLOryra
