    Alright, as other mods told me, I've waited for the reply of the person who gave me this infraction thing. But now that after I am not receiving any reply, I'm posting it on public thread, if any other mod can help me (or him/her) out. Here's the story:

    I posted a thread:

    for which "Morkula" gave me an infraction with reason "Illegal materials".

    Then I replied him/her:
    "And ROM Hacking isn't illegal?"

    For which he/she replied me:
    "Providing links to ROMs is. Which is why we don't allow that."

    Then I messaged him/her:
    "And providing/discussion hacks to COPYRIGHTED ROMs? That's not illegal? I think that comes in reverse engineering, which is illegal. Isn't it?"

    It has been 5 days since then, and I haven't received any reply yet. What does it means? I am able to see he/she is online, so don't tell me he/she hasn't got a minute in these 5 days. And what about my infraction?

    There are clearly illegal things happening here, which is why I felt comfortable to post that thread. Otherwise I wouldn't have. But what do I do now?

    Reverse engineering is illegal? Well I'll be a monkey's uncle.

    Even if it is (which I'm sure it isn't), just be a good boy and do what you're told. You don't make the rules around here.

    I'm not going to discuss ROMs or hacking. I'm just going to point out that the rules state that if you ask for websites (or provide websites) to watch full episodes, you'll get an automatic infraction - no questions asked, and no if ands or buts. Since you asked for a website, you just got what everyone who gets it gets.

    And JakeyBoy, DUDE, REVERSE ENGINEERING IS ILLEGAL!!! (unless it's an open-source code).

    All the softwares/codes have this line in their Terms & Conditions (I've read a few).
    But thanks for the website again. I've tools to download right from there too, lol...

    Oh and I'm not making any rules. PokéCommunity guys prohibited illegal things. And they're the ones who added the ROM Hacks section, both clashes each-other. But anyways, I didn't made either of these things in here, alright.
     
    There are plenty of LEGAL places to watch full episodes though, places that are supported by advertising. I don't see what the big deal is.
     
    Because if we slip up and screw up, the people who make and distribute Pokemon can have us shut down. As mentioned with the whole WPM debacle, forums like PC are technically illegal but the parent companies don't care because they get free advertising and what not. But if we start distributing potentially illegal stuff, that puts us in danger. So we can't risk it. We take the "better safe than sorry" route then risk getting trouble.

    If that inconveniences you slightly, too bad. Find other routes of getting this stuff (I heard about this site Google - it's pretty awesome). We don't have to allow stuff just to make you happy. Bye. n_n

    No. Seriously. Editing a ROM you own and dumped yourself is legal, I'm sure of it. That is, assuming dumping is legal. Which is a grey area, as has been discussed many a time. Downloading ROMs is illegal.

    BUT NOBODY HERE DOES THAT DO THEY?

    I'll be the first to admit I'm not an expert on the topic.
    Nor am I, but pretending you know a topic thoroughly when you really don't is the very essence of the internet!
     
    But if PC subscribes to the "better safe than sorry" route, that defeats the purpose of having a ROM Hacking section. Dumping is legal in some places and illegal in others; so since it is a legal grey area, it's NOT being safe rather than sorry by having a ROM Hacking section.

    Oh, copyright laws... you're clearly defined, and yet so hazy.

    Think of it this way, there's nothing innately wrong with discussing episodes of Pokémon on the internet, right? But linking to them would break legal distribution laws. In the same way, there's really nothing innately wrong with discussing ROM Hacking, as we're not providing you the materials in which you'll be manipulating. Tools, well, they're useless without the ROMs. Much the same way we could link you to a media player or editing software, but it's kinda useless without the video files. :P

    In short, we DISCUSS illegal matters, but this forum itself doesn't really infringe upon copyrights or distribution rights - something Nintendo, Gamefreak, 4Kids, etc. would be quick to shut us down for. Much quicker than simply harboring DISCUSSION of illegal materials and the over-usage of "fair use" laws that ALL fansites are subjected to.
     
    The legality of ROM hacking is definitely a tough question, but it's not your excuse to link to downloadable episodes from the internet (which in fact, has been means-tested and successfully legally enforced). Mind you, he isn't required to respond to you once you're no longer discussing the (somewhat strict, but also clearly defined) rule in question.

    In a similar way that most iPhone jail breaking sites and OSx86 forums do not infringe on copyright law as they distribute applications made to patch the software, and they don't distribute the actual code (though I mention that this is not means-tested) and exploits are discussed frequently on the web, the same can mostly be said about ROM hacking. no ROMs, no code.


    I should point out that Pokémon is not legal to stream without express permission. It's licensed to some for viewing on licensed websites such as Toonami, but Hulu, Crunchyroll and YouTube do not have licenses.

    We don't know what kind of permissions some sites may have. There are places that do these things legally; and in some instances, streaming copyrighted vidoes falls under Fair Use protections. And now jailbreaking iPhones doesn't violate copyright law. We should also consider that laws vary from place to place.

    I understand the "better safe than sorry" policy, but like I said before, that policy defeats having a ROM Hacking section.
     
    Oh, I'm sorry. It's just someone brought up linking Pokemon episodes. But in our ROM Hacking section we do link to hacking tools and give hacking advice, which might be aiding and abeiting in piracy.
     
    Meh, maybe I'm trying to read into this too much, so nevermind. But a word of advice the OP: yes linking to ROMs as well as episodes is against this site's rules. Whether or not it is illegal is not what is at issue. You were infracted on this site not arrested by state or federal officers. The site admins can define whatever rules they want and by your use of this site, you are agreeing to them.
     
    First of all, for you guys who don't know reverse engineering is illegal (you too monkey's uncle, you called yourself that, ha!), I've found one example to show you. In the Gmail's mobile app it is clearly written that noone should reverse engineer or even try to reverse engineer the code, otherwise it will be violation of copyright issues and will be taken to the court. (I'm just taking Gmail's example cause that's where I remember last time to read this line).

    And, uploading episodes online is also illegal. Having this website pokecommunity.com, using Pokémon pictures, banners, anything, without prior written permission from Nintendo, is illegal. But it isn't that Nintendo doesn't minds. It's just that pokecommunity.com is too small website for Nintendo to bother. There are many more like this, can't even name all. That's why. And yeah, Nintendo can get this site shut down anytime if they want, or ever find out about it. It is illegal.

    But suppose they don't, for the advertisement of Pokémon. But ROM Hacking is definitely illegal. Even you are discussing about it, is illegal. But let's take it this way. Suppose if discussing about ROM Hacking is not illegal, then I also just discussion where can i download Pokémon Episodes. I never downloaded, did I? I just "discussed". Never said that I'm going to downloaded (ha!). And that's just a "supposed" topic. While ROM Hacking is clearly illegal.

    My infraction must definitely be removed, as there are already illegal stuff wandering around this site, created by mods themselves. Then why do I get infraction for just "discussing"? If people wanna tell me that whatever mods decide is final (even without any solid base), that's ok with me. I'll take it as a corrupt government of some place. That's how they're acting. And then escape away after taking a baseless action...huh!

    Screw the Laws, the Admins have rules.

    You're really not making many points that haven't already been addressed, as every fansite is well aware that Nintendo or any of the other copyright holders for Pokémon are well within their right to shut us down whenever they please. We've tried to explain our reasoning, and it's fine if you still don't wish to agree with it. However, while we're here and running, and you wish to partake in our discussions, you're just gonna have to abide by our rules.

    You can close this thread now anyways. Not reading this anymore. But still, the Morkula guy/girl could have replied instead of escaping. But I understand...corrupt government is supposed to be this way.
