7 year old defends himself, accused of sexual harassment

Since when can a child get accused for sexual harassment just by kicking someone in the groin?! The other boy was choking the poor child over his new gloves, & he ends up stirring some more heat just by getting back on him. Really?

I would like to say that the bullying victim could've done something better than to actually do something like that, like say, get some counseling, report this bullying incident, possibly among other things. The same could be said for his parents - they, too, could have made some better actions to deal with that.

Even with all of this said, it's things like this that make me lose my faith in humanity...

This same thing happened to me one morning on the bus wayyyy back when i was Six years old (except the bully also scarred up my face, and i still have some :(), but back in my day (geez i sound old lol)i didn't get accused of sexual harassment, but i did get in trouble for "fighting". I am starting to lose hope in our dimwitted society.

This doesn't surprise me at all. Schools often persecute the victim, it just so happens this particular case has gained a lot of attention. It's just one of many situations where schools have failed entirely.

Happened to a friend of mine. One student attacked him, he defended himself. The attacker got suspension for a week, the defender a week and a half. Two weeks later, same thing happened. He didn't defend himself this time, but both got suspended for another week.

The store across the street has security camera's and my dad was friends with the owner. We got the video for both times and I gave them to my friend. Next day, he's back in school and the other kid gets expelled.

Moral of the story? Sometimes blackmail is the only way for justice to be served.

Anyway, haven't been able to find the list I was thinking of earlier but here is a editorial that is related. Not exactly sure when it's from, but I think it was from ~07.

Get counseling while he's being choked? The story isn't "child A chokes child B, child B attacks child A later", it's "child A chokes child B, child B attacks back to defend himself".

But really that is all this is at the moment - a story (or at least as of yesterday when I first read about this. I haven't checked again.). The school can't talk about much because of privacy issues and most of this story is coming from the boy's mother, someone who has an obvious bias. The school itself needs to look into whether this was a sexual assault/sexual harassment. That doesn't mean the school is saying it is, just that they are considering the possibility like they should. And it could be this even at the age they're at. It's not about whether the attacker gets any pleasure out of the act, but that the victim did not want it. If it's a 7-y/o kid it might mean he's not completely aware of what he's doing, (again, if that is what happened), but that doesn't mean the act can't be a sexual assault.
