Ash didn't steal the Pokemon if Charmander decided that he wanted to go with Ash instead of Damian. It was Charmander that decided to use Flamethrower on Damian; Ash did not command Charmander to do it. So I basically fail to see how it would be considered stealing. Pokemon aren't property to begin with. :V

Captured pokemons ARE property! They are not allowed to have free will. Island of the Giant Pokemon illustrate this perfectly.

It used firebreath on its master? Who cares? Did plenty the same time on Ash from various reasons. But no matter how much it hated, petied, despised Ash, could not get away. Remained SLAVE of him.

Ye, and just because officially Ash is "the hero", and charizard's actual owner was a "prick", and charizard breathed on him, you oh-so-sudden overlook the fact that Ash just stole a pokemon. The same person who generally likes to steal. Ash stole bicycles, motorboats, and who-know-what else during his career. Ok, he never stole an entire stadium (unlike Jessie and James), but c'mon!

It was implied that Damian when abandoning Charmander had released it from his Pokeball, considering Damian tried to throw the Pokeball at Charmander when demanding that he return to him, when had it been under his ownership, he'd use that laser recall function, like most Pokémon Trainers do with their Pokémon both before and after this episode.

This property's owner is voided, ergo, it can become different.
Changing ownership of voided property is by no meaning a theft.

First of all, it DID manifest in action (or have you completely forgotten that Damian was shown throwing Charmander's Pokeball at it while yelling "Charmander, return!" instead of using that laser recall function that most trainers both before and afterwards used).

Second of all, he needed to get away from those flock of Spearow quickly as well as quickly get to the Viridian Pokémon Center to get his Pikachu healed up. Granted, Pikachu's condition was largely his fault, but still... I guess you have a point regarding the motorboat, though.

Probably because it was already released But Damian was just too arrogant So he believe he can get back his released Pokemon with his old pokemon.

Clearly you haven't read it, because if you had, you would have noticed that I specifically mentioned that while he said that, he was clearly shown throwing the Poke Ball, not using that laser recall thing.

Based on Dogasu's comparison of the episode (and bear in mind, this is the redo comparison), the only change of note is that the dub omitted Damian's comment that Charmander was weak enough to be defeated by a Poliwag, just changing it to just being weak to many Pokémon (though they still kept the gist of what he was saying when Brock mentioned Charmander was naturally weak to water types), meaning most likely the return thing was in the Japanese version.

And Twilight, Damian actually THREW the Pokeball at Charmander. The return function, as demonstrated by many characters both before and AFTER this episode, had them using that laser function. Yes, he might have said "return," but the actual actions indicated he was actually trying to throw the Pokeball at Charmander, not simply having it return to his Pokeball, something that hasn't been demonstrated before or since, which implies that he actually released it.

Is he even licensed to begin with? He certainly has more than six Pokémon in his party (Based on what was stated exactly two episodes later, a licensed trainer, ie, a trainer with a Pokedex, has a limitation of six Pokémon, and their Pokémon once they exceed capacity goes to the person they got their [first] Pokedex from (in Ash's case, Professor Oak), and Episode 2 mentioned his Pokedex IS a trainer's license (Episode 7, Waterflowers of Cerulean City, also implied that Gym Leader badges act as licenses/IDs as well).).

How about this:

Pokemon Anime and is totally different from the games. In the games, most pokemon are more like mindless beasts. In the anime, they are more sentient. This is also true with Pokemon Manga.

Pokemon don't have their mind erased, they continue to remember their own trainers. Ash's Tepig was abandoned and Ash took it in and caught it, but Tepig still remembered its own trainer. Dawn and Ash traded pokemon, Aipom still remembered Ash.

Honestly, your whole argument is invalid for the anime. Because the anime is totally different from the games and the manga is different from the games, but not as much as the anime.
