Is downloading a ROM game is illegal when you have a physical cart?

"It is illegal to download a Nintendo ROM from the internet whether or not you own an authentic copy of that game". Nintendo will never switch stances.
However, facing a consequence for simply downloading a rom will never happen. So it comes down to how you morally feel about such things.
