3rd Gen Move Deleter question

So I was about to migrate my Emerald pokemon over to Diamond and I was at the Deleter when he told me my Swampert didn't want to forget Surf. Can anyone help me with why this has occured since I only have the emerald for afew more hours until I have to return it and I don't want to leave my Swampert behind.

u can not migrate a pokemon if it know a HM move. the move deleter should erase it for you. if the attack will not be erased, im afraid to say that the pokemon might be hacked.

I know that that you cannot migrate the pokemon with HMs. This is why I am curious and mad that my Starter pokemon won't forget Surf. I am 100% sure it is legit since I started the game with it. The Move Deleter says "Your Mudkipz(nickname) seems to not want to forget this move."

emmm.. im not sure that seems kind of weird. it might be because your mudkip likes you, you might have to upset it a little.

Nothing seems to work. I have made it like me less but still nothing.
Does anyone else have any idea? I don't have the game much longer.

EDIT

I discovered that if you don't have another pokemon that doesn't have Surf learned at the time of trying to get another to forget. That the pokemon will not forget it. I don't know if this is for all the HMs. I don't remember this being so but I taught my Wailord surf and my Swampert finally forgot Surf right afterwards.
