Let's see who has a hat:

Red, Blue, Yellow (iffy), Gold, Ruby, Sapphire (do bandanas count?), Dia, and Berlitz.

So Green, Silver, Crystal, Emerald and Pearl don't have hats. It almost balances out...

EDIT: Oh, whoops. Wally doesn't have a hat, either. Right. ^^
