Both... technically, the sites and ROMs and RM2K, fanfiction, fanart, it's technically all illegal because it's going against copyright stuff. :/

But no one really goes after these places... 'cept if you're out selling the stuff and whatnot.

Accually the fanart, fanfic, and so on is legal.. (at least so far, here in the US) it's called fair use and as long as your not selling stuff (then u'll need a lic) or using more then some made up percentage (avg about 15% currently) you're OK.

As for IPS patches. they are 100% legal.. the roms that they may be used on, however, aren't legal.
 
LOL... but RM2K *is* 100% illegal. That's why they made sites take it off download pages XD. Doesn't stop us 2kers though XD

I've had people complain of pop-ups, but I have a blocker and have never gotten any.

Before you visit, please read the details below:

Silver Koopa & Friends (SK&F) is a hilarious sprite comic website about the adventures of Silver Koopa, Orbit, Sword Kirby, Ulti Kirby, Melbirn, and Klunk as the foil the idiotic plots of the robot B-Z. Take a trip to the comical Koopa Island and enjoy the amazing scenery but watch out for crazed giant donkeys!

Here are a few things you need to know. Some of the humor on SK&F may be PG-13. You are advised not to click the link if you think you may not be able to handle or under stand the humor in these comics. Some material my include:

Humorus Violence, where a character gets hurt bad in a funny way but dosnt die. There usualy is blood when a character gets hurnt.

"Almost Cussing", Kinda like when a character starts to say a cuss word but gets interupted. There are instances where a character says "WTF!?".

There are some refrenses to God.

There is "Potty Humor".

There are NO drugs and NO nudity in SK&F.

Well, it lacks content and good artwork. It only has cheats and only for the games, no pokedex or cards or strategy guides or anything. And there is so much red!!! -_-

-IPS patches are legal as they can be considered as free modifications for games...
-Fanfics, fan-art, fan-made games are not cared anymore.
-Roms issue does not seem certain.Around 3 years ago everywhere was full of roms.Then where was the COPYRIGHT???I personally think that roms can be used for 24 hours in testing purposes though the **** people spoilt this and soon roms turned into completely bad things...
-RPG MAKER IS COMPLETELY ILLEGAL as they are translated and cracked forms of a japanese game making software...-I don't know what happened to the Russian guy who translated them...Don Miquel...-
