Stealing

Lol. I always used to correct people on (other) forums when they said could care less. I've probably been seeing it too much. COULDN'T CARE LESS.

It strikes me that the MMO makers were probably wanting funds to keep it going, which falls under the category of profit. I'm not at all surprised Nintendo wanted them to cut it out
The one I brought up that I specifically heard of did not take donations, as far as I know. The article I read said that the developers paid for the servers themselves, so that somewhat implied they didn't do donations. They also did not make you pay to use their service, this I know. It was actually an open source project, apparently. But again, being an MMO, it is larger than a fangame made here, and is more of a threat to Nintendo than these smaller games.

Being open source MMO of someone else's work is a quick way to get shut down. A handful of fanmade closed source online games won't make a difference, but if they made the server so easy to use anyone could do it? Well it would be quite the pandora's box. Everyone and their mother would be opening a server. That was the only real threat, that and reducing the uniqueness of their IP. Honestly, I can't blame them.
 
Stealing is no-no. Stealing is stealing. Is it more "right" to steal from a billionaire than a bum on the street? No, stealing is stealing. Is it "right" to murder an evil dictator like Kim Jung Il because every one hates him? No, murder is murder. Yes, it will do the world a favor, but still the act of murdering another human being itself is a no-no.
