If they were unfairly banned, it's only fair to unban them.

I guess it's fair to unban them. Give the person a second chance at being a better person than the time before he/she was banned.

I don't know the circumstances involved around this person or their ban, but if the ban really was "unfair" then it is your job too look through all the evidence proving that it was indeed unfair and over turn the action. Regardless if people like this person or not, if the person has continuing cases of acting up then just re-ban them because you gave them a verbal warning to stay in line upon being unbanned(or at least I would if that were the case).
