well he's using a lot of nintendos graphics?
and pokemon is copyrighted..

so it would be considered plagarism.
and even if all the scripts and graphics were custom.
i think its against the terms and conditions of rmxp with enterbrain.

As AR said, it's not that he's using RMXP, it's that he's using Nintendo's copyrighted materials. Even if he remade all the sprites, the Pokémon names and concepts themselves are trademarked/copyrighted... Technically, all fangames and ROM hacks are illegal, it's just that nobody's going to sue you unless there's money at stake.

It's not illegal to sell RMXP games, by the way. Have you ever heard of Aveyond? It was made in RMXP, yet still managed to sell quite well...

You can sell an RMXP game even with the default scripts and graphics... However, you shouldn't sell a fangame, as you're likely to be sued (or at least sent a cease and desist order).

Why would having your own website matter?
Like say for raptor? If he had his own website, it would make no difference what so ever.
It would still have nintendos stuff in it.
Unless I'm missing the point of your question?

No they wouldn't, as long as you have already payed for the software.

A news here.
I'll start beta-testing Pokemon Raptor myself by fixing bugs, adding some minor things.
Then, I'll problaly ask for someone else to fix my grammar.
So everything going to be done real soon.
I can't really reply every post since I'm busy at the momment ( Exam again... ).

Nintendo would find out...
There's no getting around it, you can't legally sell a fan made pokemon game.
Getting a secret website would not help you..
 
How would they if you don't advertise to the public
