A crime is almost always a crime only if it fulfils both actus reus (guilty act) and mens rea (guilty mind). An insane person cannot really be convicted with the purpose of retribution any more than an autoimmune patient can be condemned for suicide. :/

Hmmm that's why I don't really like the idea of 'rehabilitation' I guess.

What really get's me though, is the fact that the people who kill others with motive (such as a family member killing another member), might only, let's say get 10 years in jail (not sure of the real number). Well just think, what they wanted to get done, is done, and in 10 years or whatever the amount, they're out and freer than free. They'd knocked off what they wanted to do. It to me, would seem as though they have been granted a reward.

The judicial system needs a real overhaul :S
