First of all, greetings to everyone. Hope you are having a good day and all of you are healthy.

Second. I'm only writing this because I recently became of knowing about Rom hacks and fan games. And I've been loving a lot of them. But, whenever I enter to a post, find a deviantatart page or Instagram page with cool designs, like fakemons or characters or even maps, I see the authors posting about no one can use their artowork for anything or selling the rights of their work.

So a thought came to my mind a few days ago. I understand artists should be credited for their work, and they can sell their artworks, etc. Why can't people use their designs in fan games or ROM hacks without their permission, if these kind of games are just that? Fan games? No profiting games?

I mean, aren't they already using stuff and designs and concepts from Nintendo without their permission? Is there something am I missing here? I just would like to see people use some designs in some games as many of them I have found are just for showing them off?

    Have a great day everybody.

I mean, you can. There is nothing stopping you. There is no internet police force who will break down your door and arrest you. But doing so is generally a display of poor manners and a lack of courtesy. And while I do advocate that people should not concern themselves with being badmouthed on Twitter, you don't want really want to be viewed as a hooligan.
