Well from what I've seen, usually the judge is the game master, meaning they're the one's who've created the scenario. They explain what's going on and what evidence to provide. People can then take part as witnesses, prosecutors, defendants, Dick Gumshoe and so on for a case. Apart from that it's all I've gotten so far. Witnessed would be allowed to make up their own testimonies and both sides would have to prove either guilty or not, depending on if they're the prosecutor or lawyer.
There would be things the witnesses would have to know, like what they were doing but from there everyone makes everything up.
