You will need to ask them first. it would be the decent thing to do. If they say no, then don't, if they say yes, then give them credit as well, as they did all the hard work, and ripping tiles from one ROM to another isn't too hard.

True as that is, there's still plenty of people using Bases, and there's very little Rom Bases for Emerald. To be honest, I was really wondering "since it's released to the public, does that mean we can rip from it too?". (your answer works for this too though, so thanks ^-^).
