Admittedly, I'd never heard "suimasen" before today, but this seems to suggest that "suimasen" is more colloquial than "sumimasen". :s If this is true (idk if it is), then there is a difference in the connotation, even if the denotation is the same.

EDIT: Oh, I just saw this:

1) I don't hyphenate it. ;[

2) Depending on which aspect of failure you're talking about, it's not a non sequitur. For example, if you were saying that he failed to prove it because he didn't prove it, then you were correct (even if it is a tautology). Since you didn't specify, it's not easy to say, though. ;P
