It's technically illegal, just like making fangames, but as long as you don't claim the music as your own or sell the game the music is in, whoever made the music won't care.
If we're talking about using other games' music design-wise, I'd say that you should pick music that fits the game. From a legality standpoint, don't try to make money off of it unless you have an explicit license saying that it's okay to use it in a for-profit project(and even then, if you're looking into making a profit, make absolutely sure you're in the clear by either talking to a lawyer or the creator of the music directly).
