True, but Gonzales v. Raich, passed by a politically charged and more contemporary court, essentially talked about how regulating intrastate commerce isn't outside the scope of the commerce clause if it can indirectly affect interstate commerce.
Personally, I support the legalisation of marijuana. But you can expect this to be contended in the Supreme Court again.
It wasn't just the conservatives. When I spoke of politically charged, I speak more of the general "ZOMGWARONDRUGS" tendency from both sides. Rehnquist and Thomas (two generally conservative judges) dissented. Ginsburg and Breyer (generally liberal ones) concurred. What disappointed me, though, was Scalia's concurrence, because he usually is consistent and principled, if nothing else. :/Netto Azure said:Yeah, but someone needed to point out the obviously polarized and political Supreme Court conservatives still has their States Rights roots to look into.
