Well, actually, one one of the beasts are in FR/LG, leastways one per game file. Not to mention that they are roaming Pokemon, and if they use Roar they cannot be encountered again. On the other hand, Colosseum can be played on the Wii...
The main point is that these Pokemon are not available in 4th gen games. Various 1st and 3rd gen legendaries are so far obtainable in Platinum, indicating perhapes Nintendo want them for the most part to be obtainable for those who haven't/won't play the third gen games (GBA games are getting obsolute) - but the Johto beasts aren't available in a 4th gen game yet. A notable absence - but why?

True - it could count for nothing, but I doubt it. Taking Colo and XD Pokemon as an example - they say they are obtainable 'From a Distant Land' - not from Orre, which strikes me as odd. They probably hadn't programmed in anything saying Orre for RS and all, so just went with that anyway. Yet, in Diamond and Pearl, amognost all the other regions (including the reuse of 'Distant Land'), were two spots labeled 'Johto'. I've seen the coding for myself first hand. But why do it? It shows that, at the very least. they were considering making a remake, and the continued 'evidence' for this possibilty merely underlines it. Sure, it might not happen, as I've said eariler, but it certainly does mean something IMO.
except for celebi, every pokemon in johto can be caught.

Ah, but not every Pokemon from Johto is obtainable in 4th gen game. Kanto legendary birds got in despite being availalbe in XD
and FR/LG, unlike the Johto beasts in which all three availble in Colo, and one of them in FR/LG in 'harder' circumstances'. The Regis too are available thus far. But not one of the Johto legendaries - the beasts or Lugia/Ho-oh - are in a 4th gen game yet. Some other non-legendary Johto Pokemon too aren't readily available in 4th gen games just yet.
Meh, I'm feeling objective today. 'Cause', it isn't going to happen or not happen for sure, but IMO all these things point towards a remake happening rather then not.
As for the Togepi thing - who's to say you wouldn't get a different Pokemon in the remake? 'Cause, that's if they don't copy everything that GSC was like to a T...

Nope. Platinum, for instance, hadn't been copyrighted or the such (in fact the website domain for Poke. Platinum I believe already was taken by a fans forum or something?), but Opal had. And many people thought that the neame couldn't possibly be Platinum, but be Opal. Goes to show it doesn't actually count for anything. In fact if you look around you can find some fake boxart for those games already - emphasis on the fact that it's fake.
